Here you will find the General Terms and Conditions (“TOS”). Please read the General Terms and Conditions carefully, as they regulate the legal relationship between us and you as a customer and are binding. We are always there for you if you have any questions.

For the purposes of these TOS, Careforsons Ireland Limited shall be referred to as “Careforsons” or “we”.”

How You Can Contact Us. You can contact us by writing to our mailing address above, calling us at 00353 238804269, emailing us at hello@sons.ie, or contacting us through the chat feature on our websites under www.sons.ie. If you log into your patient account, you can also contact us using the live chat function where a member of the customer services team can support you there.

How we can contact you. If we need to contact you, we will do so by phone or in writing to the e-mail address or mailing address you provided when you placed your order. We can also reach you through your patient account and send you direct messages.

SONS WEB SITES

What these TOS apply to. We operate the websites at www.sons.ie (“Sons Websites”). We are commissioned by our partners (doctors and pharmacists) to refer to and inform about the activities of our partners. We expressly point out that we ourselves do not provide medical services and do not sell medicines.

These TOS apply to your use of our websites, the use of your patient account, your contracts with our partners and the communication with the attending physician of the medical practice as well as the online pharmacy. Furthermore, the TOS apply to the assertion of own and assigned claims by us. By using our website or placing an order, you agree to these terms and conditions.

OUR CUSTOMERS

Who can use the Sons Websites. Prerequisite for the use of all services indicated on our websites is that you want to use services exclusively for yourself, are male and at least 18 years old. You must also have a valid delivery address in the  Republic of Irelandand a valid credit or debit card in your name.

Please note that you have to pay for remote treatments and medications yourself (self-payer), there is no billing with your health insurance.

Online Doctor Healthcare Now LtdYou can contact doctors through our web pages. You can contact a doctor via our website or directly via their website and ask him/her whether a certain treatment is suitable for you. If the doctor comes to the conclusion that remote treatment is indicated for your complaints, you will conclude a corresponding remote treatment contract with the doctor’s office; the remote treatment contract is concluded exclusively between you and the doctor’s office, we are not a party to the remote treatment contract.

The medical practice. The prescriptions are provided by the independent online doctor

(the “Medical Practice”)

offered and performed (“Physician Practice”). The physicians acting on behalf of the Medical Practice are professionally qualified to provide the remote treatments described on the Websites and have both the expertise necessary to perform the remote history and diagnosis and treatment needs and professional liability insurance covering the risks of remote treatment. The physicians are based in the European Union.

For the treatment relationship with the medical practice, the General Terms and Conditions of the medical practice included in the treatment contract shall apply – insofar as they exist – and otherwise the applicable legal provisions. Before the treatment you have to fill in an online questionnaire. In order to place an order and thus ask the doctor whether a certain treatment is suitable for you, you must first complete an online questionnaire via the Smartscripts platform  and, if necessary, upload images of the relevant body parts. The online questionnaire contains various questions about symptoms, pre-existing conditions, any allergies as well as any medication taken, living conditions and other information deemed necessary by the doctor’s office. The truthful and complete completion of the questionnaire and any medical follow-up questions is a mandatory prerequisite for the remote treatments and any drug deliveries.

The online questionnaires will be continuously monitored and evaluated by the doctor.

Diagnosis and prescription. The prescribing doctor reviews the online questionnaire then checks whether the remote treatment you have selected is indicated, makes a diagnosis if necessary and, based solely on professional considerations, checks whether medicines are suitable for you to contribute to a successful treatment. If this is the case, the doctor will issue a corresponding prescription. If the doctor deems it necessary to contact you again before diagnosing and, if necessary, recommending treatment , the doctor will contact you by e-mail or via the message function in your patient account.

Refusal of the offer if the treatment is not suitable for you. The doctor’s office can refuse remote treatment if the doctor’s examination shows that remote treatment is not indicated. In this case, you will not be able to receive remote treatment, you will not receive a prescription and you will not receive any medication.

MEDICINE DELIVERIES FROM THE PHARMACY Epharm via www.sons.ie

You can contact a pharmacy through our website. You can also have a prescription issued by your doctor within the framework of remote treatment forwarded to an online pharmacy via our website and order the prescribed medication from the pharmacy. The contract for the purchase of the drug is concluded exclusively between you and the pharmacy, we are not party to the purchase contract.

The pharmacy. The sale and supplyof the medicine is carried out by the Online Pharmacy

ePharm NI is a registered pharmacy with the Pharmaceutical Society of Northern Ireland (no. 582). Careforsons Northern Ireland / ePharm NI are registered with the Information Commissioner’s Office (ICO). Our Pharmacy is fully compliant with the EU GDPR directive. (the ” Pharmacy”)

For the order of medicines from the Pharmacy, the General Terms and Conditions of the Online Pharmacy vis-à-vis consumers in distance selling, as far as they exist, and otherwise the applicable statutory provisions shall apply.

Subscription. The medicines will be delivered to you, upon your choice, every one month or every three months, provided your treating physician issues a corresponding prescription.

Symbol photos. The medicines purchased may differ slightly from the images. The images of the products on our website are for illustrative purposes. Although we have made every effort to accurately represent the shape, style and colors, we cannot guarantee that they will look exactly the same.

Rejection of the offer if the dispensing of the drug does not appear to be warranted. The Online Pharmacy reserves the right to refuse to dispense the medicines to you if this seems advisable for reasons of drug safety and patient health. Any fees already paid by you for the purchase of medicines will then be refunded to you immediately using the means of payment originally used by you.

ORDER PROCESS

What your order includes. Provided that your answer to the questionnaire indicates a request for remote treatment, you can, after filling out the questionnaire on our website, specify the desired drug(s) and, if applicable, the dosage/package sizes offered for selection. After entering the necessary personal data and selecting the payment method, you submit your following binding contract offer by clicking the electronic button “Order now and proceed to checkout”, which we forward to the doctor’s office and the online pharmacy:

  • Remote treatment: application to conclude a remote treatment contract with the online pharmacy;

and, if you wish to have medicines delivered by our cooperating pharmacy,

  • Purchase of medicines: Application to conclude a purchase contract for the medicine prescribed by your doctor with the Online Pharmacy.

The applications for the purchase of medicines are subject to the condition precedent of a corresponding prescription by your doctor.

You can only submit your applications and send them to us if you agree to the validity of these General Terms and Conditions, the General Terms and Conditions of Business of the cooperating doctors and the cooperating pharmacy vis-à-vis consumers in distance selling, the consumer revocation instructions and our data protection information by checking the appropriate boxes.

By sending your order, you release the doctors and pharmacists treating you from their duty of confidentiality for the purpose of transmitting the medical prescription and billing by Careforsons and agree to the data transmission required for this purpose. This is a prerequisite for the transmission of your contract offers to the doctor’s office and the online pharmacy. If you do not agree to this, it is not possible to conclude a contract.

Please note that in the interest of security you may only conclude one subscription per product. We reserve the right to cancel and refund subscriptions if we have reason to believe that the same person has taken out two subscriptions.

You will receive an automatic order confirmation and acceptance of your offer. Immediately after receipt of your order you will receive an automatic order confirmation from us. The doctor’s office and the online pharmacy have not yet accepted your order at this point; there is no binding contract until your questionnaire has been checked by a doctor at the doctor’s office and he/she confirms that remote treatment is indicated and, if necessary, that the prescription should be issued. If this is the case, we will send you a confirmation with your treatment plan, diagnosis and recommended therapy by e-mail, with which we accept your respective requests on behalf of the medical practice as well as the online pharmacy, if applicable. We will inform you if the medical practice or the online pharmacy cannot accept your offers.

If you wish to change your order. If you wish to change your order, please contact us by email at hello@sons.ie or by phone at 00353 238804269.

If you want to fill the prescription at your local pharmacy or at another mail order pharmacy. You have the choice of obtaining the medicine from another pharmacy of your choice. In this case, we will send you the prescription for further use or send the prescription to a pharmacy of your choice. If you order the drug from a pharmacy other than the online pharmacy, no purchase contract is concluded with the online pharmacy. You purchase and pay for the medication at the mail-order or on-site pharmacy of your choice. In order to receive your prescription, you must contact us via email at hello@sons.ie

REGISTRATION REQUIREMENTS AND YOUR PATIENT ACCOUNT

How to use the Sons Website. We provide browser-based websites that can be accessed via the Internet. In particular, communication with the treating physician will be done through our websites. You are responsible for providing all the software and hardware you need to access the websites, such as a computer, internet connection, and compatible web browser software.

You must register and create a patient account. To use the services offered on our websites, you must register on our websites at www.sons.ie and create a patient account. To do this, you must identify yourself as a user of the websites by providing your first and last name, e-mail address and home address and set a password. You are solely responsible for the security of the password and the confidentiality of the patient account. You must inform us immediately of any suspicion of possible misuse of the password or the account.

Only you are allowed to use your patient account. Registration is only allowed for natural persons in their own name. Attempting to register in someone else’s name will result in immediate exclusion from using the Website. If it turns out that an account has not been set up by a customer in his own name, all contractual relations between us and the customer will end with immediate effect without the need for a separate declaration. We reserve the right, in our sole discretion, to terminate or restrict Customer’s access to the Website or withdraw any password or username at any time and without notice, including, without limitation, if at any time we believe that Customer is in breach of this provision of the TOS.

You are entitled to use the Website to the extent granted to you for the duration of the access granted to you. By posting content, you grant us a simple right of use, free of charge and for an unlimited period of time, to use the content for purposes of the use of the Website, as well as the right to sublicense this right. The patient account may not be used to store content whose provision, publication or use violates applicable law or agreements with third parties. You shall use the Website in a manner that does not interfere with, overburden, or damage the Website and does not compromise or circumvent the purpose of the Website. Without prejudice to any obligation on our part to back up data, you are responsible for entering and maintaining the data and information required to use the Website.

We strive for a constant availability of the respective agreed services. However, we are not liable for the accessibility, availability and functionality of the Website. We may temporarily limit the availability of our Website if this is necessary with regard to capacity limits, to carry out maintenance work or for security reasons.

YOUR DUTIES OF CARE

Answer all questions truthfully and completely. You are obligated to answer all questions posed to you truthfully and completely within the framework of the online questionnaire, a possible inquiry or otherwise in connection with or for the provision of medical treatment or the dispensing of medicines. You must inform us immediately of any changes in your state of health during treatment that are or could be likely to influence the assessment of the attending physician.

Your Duty of Care. For your own safety, you are obligated to check whether you have received the correct medicine

  • to check whether you have received the correct medicine and also the medicine you ordered (no wrong delivery);
  • to check whether the outer packaging and any seal are intact or whether the package is damaged;
  • check the expiration date printed on the package;
  • read the package insert carefully.

CONTRACT DURATION

How long the contract will run. This is a continuous prescription of medicines based on a diagnosis made by the attending physician, whereby the treatment cannot be agreed beyond the period considered reasonable at the time of the customer contact and for a maximum of six months. The specific duration will be determined by the particular plan for the treatment. In order for the treatment to be extended, you must fill out the online questionnaire every six months, and update your relevant health status.If you do not fill in the online questionnaire, we will consider this as a cancellation of your subscription.

How to cancel the contract. You can cancel your contract with the doctor’s office and the online pharmacy at any time with immediate effect. You can cancel directly in the patient account or by or e-mail. Please send your cancellation to: E-mail: hello@sons.ie

Contract on the use of the Website. The duration of the contract on the use of the Website exists until you delete your patient account.

COST

Remuneration for remote treatment. A claim for reimbursement arises for remote treatment by the  prescriber. The reimbursement is independent of any prescription of a drug.

Remuneration for the purchase of medicines. A purchase price is due for ordering medicines from the Pharmacy.

Subscription. The cost will be, upon your choice every one month, every three months or every six months. In case you choose a supply of three-month packages, you can choose upfront payment

PAYMENT PROCESSING

Assignment of Claims to Careforsons. The doctor’s office and the online pharmacy assign their claims from the contracts with you to us. On the basis of your declaration of release from confidentiality and your consent to the transfer of data when you submit your order, we are entitled to invoice you for the costs arising from the treatment contract with the doctors and the costs arising from the purchase of medicines from the pharmacies.

Processing of payments. All payments are processed by Careforsons. After the conclusion of the contract, you will receive a total invoice from us for the claims assigned by the doctor’s office and the online pharmacy. The means of payment specified by you will only be debited when the invoice is issued.

Payment by credit card. If the individual offers do not contain a separate note on payment, payment will be made by credit card.

DISCLAIMER

How we are liable. We are liable for damages caused by us or our vicarious agents or legal representatives intentionally or through gross negligence. Any liability on our part or on the part of our vicarious agents or legal representatives for slight negligence, irrespective of its legal basis, shall be limited as follows:

  • We shall be liable in the event of a breach of material contractual obligations up to the amount of the damage foreseeable at the time of conclusion of the contract and typical for the contract;
  • We shall not be liable for slightly negligent breaches of other obligations.

This does not affect our liability for damages arising from the breach of obligations whose fulfillment is essential for the proper performance of the contract and on whose compliance you may regularly rely. The above limitations of liability do not apply in the event of injury to life, limb and health and liability under the Product Liability Act. The above limitations of liability also apply accordingly to liability for futile expenses.

CANCELLATION

Your right of withdrawal. As a consumer, you are entitled to a right of withdrawal in accordance with the statutory provisions, about which we hereby inform you.

Cancellation policy. You have the right to revoke your declarations of intent within 14 days without giving reasons, of which we hereby inform you on our own behalf and on behalf of the medical practice or online pharmacy. The revocation period is 14 days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the first goods.

You can use the attached sample cancellation form, which is not mandatory. To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period. To meet the cancellation deadline, it is sufficient to send the cancellation in time to:

We are the receiving agent for your revocation declarations to the medical practice and/or the online pharmacy. If you effectively revoke the remote treatment contract, you are at the same time no longer bound to the purchase contract concluded with the online pharmacy. The reversal of the amounts paid by you will be made in all cases through us. In all cases, the medications are to be returned to the online pharmacy supplying you.

Consequences of revocation. If you revoke this contract, we will reimburse you all payments we have received from you, including the delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), without undue delay and no later than within fourteen days from the day on which we received the notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment. We can refuse the repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

Return of goods. You must return or hand over the goods to epharm NI 3c Bluestone Business Park, Moyraverty West Road, Moyraverty, Craigavon, Co. Armagh, BT65 5HU  immediately and in any case no later than fourteen days from the day on which you notify us of the revocation of this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days.

You bear the cost of return.

You must pay for any loss in value of the goods only if this loss in value is due to a handling of the goods that is not necessary for the examination of the condition, properties and functioning of the goods.

Expiry of the right of withdrawal. The right of withdrawal in relation to the distance treatment contract expires prematurely if the medical practice has already begun with the performance of the service after you have given your express consent to this and at the same time confirmed your knowledge that you lose your right of withdrawal upon complete fulfillment of the contract. The right of withdrawal also expires when we or the medical practice has fully performed the services.

The right of withdrawal does not apply to the following contracts:

  • Contracts for the supply of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer;
  • Contracts for the supply of perishable goods or products whose expiry date would be quickly exceeded;
  • Contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery;
  • Contracts for the provision of services, the service has been provided in full and the performance of the service has begun only after the consumer has given his express consent to this and at the same time confirmed his knowledge that he loses his right of withdrawal upon full performance of the contract by the entrepreneur.
  • The right of withdrawal under these provisions also does not apply if you purchase your medicine in an on-site pharmacy.

By submitting your contract offer, you expressly agree that the medical practice and the online pharmacy may begin providing the services before the expiration of the cancellation period. You are aware that your right of withdrawal expires as soon as the respective service has been provided.

DELIVERY

Delivery costs. The costs of delivery will be as displayed to you on our website.

Delivery Timeline. Your order will be shipped and delivered within specified timeframe unless further action required (i.e. follow up from Customer Success team). Before this point, order is still classed as ‘pending’.

We are not responsible for delays outside our control. If our supply of the products is delayed by an event outside our control, then we will contact you as soon as possible to let you know and we will take steps to minimize the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any products you have paid for but not received.

If you are not at home when the product is delivered. If no one is available at your address to take delivery and the products cannot be posted through your letterbox, we will leave you a note informing you of how to rearrange delivery or collect the products from a local depot, or where packages are delivered via DPD or other provider, you can find out more about their terms and conditions and what to do if you need to rearrange delivery at the following link for DPD:  https://www.dpd.co.uk/standard_terms_and_conditions.jsp

If you do not re-arrange delivery. If you do not collect the products from us as arranged or if, after a failed delivery to you, you do not re-arrange delivery or collect them from a delivery depot we will contact you for further instructions and may charge you for storage costs and any further delivery costs. If, despite our reasonable efforts, we are unable to contact you or re-arrange delivery or collection we may end the contract, in which case we will refund you but may deduct or charge you reasonable compensation for the net costs we incur as a result.

If you do not allow us to provide services. If you do not allow us to perform the services as arranged (and you do not have a good reason for this) we may charge you additional costs incurred by us as a result (for example, if we schedule a consultation at a particular time but you do not make it). If, despite our reasonable efforts, we are unable to contact you or re-arrange performance of the services, we may end the contract and you must compensate us for our net costs we incur as a result of you failing to allow us to provide services.

When you become responsible for the goods. A product will be your responsibility from the time we deliver the product to the address you gave us or you collect it from your designated mail drop or local depot.

When you own goods. You own a product once we have received payment in full.

Reasons we may suspend the supply of products to you. We may have to suspend the supply of a product to:

  • deal with technical problems or make minor technical changes;
  • update the product to reflect changes in relevant laws and regulatory requirements.
  • make changes to the product as requested by you or notified by us to you.

You may contact us to end the contract if this leads to a delay of more than 14 days.

USE OF OUR WEBSITE

What applies to the use of our Website. Your use of our Website and any other services offered to you through our Website are subject to the following additional Terms of Use.

  • You may not use the Services unless you accept these Terms of Use. By using the Services, a free contract for the use of the Services is concluded between you and us.
  • An uninterrupted and complete availability of the services cannot be guaranteed according to the current state of the art. We are therefore not liable for the constant and uninterrupted error-free availability of the services. Disruptions or maintenance work may limit or temporarily interrupt their use. Insofar as we have influence on interruptions (e.g. during maintenance work), we shall endeavor to keep such interruptions as short as possible.
  • The use of the services can be achieved by means of a personal computer (PC) via a web browser on the Internet, preferably via DSL or an equivalent connection. If the services are used via other Internet-capable end devices, both the range of functions and the display may be limited.
  • The contents of the services are created with the greatest possible care. However, we do not guarantee the accuracy, completeness and timeliness of the content provided by the services. Likewise, we do not assume any liability for data security outside our area of control and the risk of data loss during the transmission of data via the Internet.
  • The Services may contain links to third-party websites (so-called “external links”). Since we have no influence on their content, we cannot accept any liability for the external content. The respective information provider of the linked website is always responsible for the content and accuracy of the information. At the time of linking, no legal violations were apparent. As soon as we become aware of a legal violation, we will immediately remove the respective link.

The doctor’s office and the pharmacies remunerate our commissioning in line with market conditions

DATA PROTECTION

We protect your data. We comply with the legal regulations on data protection and process personal data only insofar as we can base the processing on a legal basis or on commissioned processing.

Release from the duty of confidentiality. By placing your order, you release the medical practice and doctors working for the medical practice, the online pharmacy and pharmacists working for the pharmacy from their duty of confidentiality for the purpose of transmitting the medical prescription and billing by us and consent to the data processing required for this purpose.

FINAL PROVISIONS

Severability Clause. Should individual provisions of these General Terms and Conditions, including this provision, be incomplete or wholly or partially invalid, this shall not affect the validity of the rest of the General Terms and Conditions. The respective statutory provisions shall take the place of the incomplete or invalid provisions. This shall also apply if the gap requiring supplementation subsequently becomes apparent.

The law of the Republic of Ireland shall apply. The contractual relationship between you and Careforsons shall be governed exclusively by the laws of theRepublic of Ireland , excluding the UN Convention on Contracts for the International Sale of Goods, unless otherwise stipulated by mandatory consumer law.
